1. SCOPE OF APPLICATION
The subject of these general terms and conditions is the purchase of products and services at a distance via the Internet on the website "ferramentarusso.com", which is registered and owned by:

The following general terms and conditions of sale form an integral part of all our contracts for the supply of materials, even where orders are placed by telephone, verbally, by fax, by e-mail or via the Internet.
Ferramenta Russo by Russo Sabino sells the products listed on this site primarily to professional customers (users understood as craftsmen, professionals, traders, wholesalers, retailers, etc.). In this case, the customer guarantees that the purchase of the products is made exclusively for professional purposes, i.e. in relation to his own work. In the case of direct sale to a "consumer" (a natural person acting for purposes not related to his or her professional activity), the relationship between Ferramenta Russo by Russo Sabino and its customer is governed by the regulations for the protection of consumers, Legislative Decree of 22 May 1999, n. 185.
1a. RETURN RIGHT
The Customer, if he/she is a "Consumer" as defined in point 1 and in accordance with Legislative Decree no. 185 of 22 May 1999, may exercise his/her right to withdraw from the contract within 10 working days of receipt of the goods, by returning the purchased goods, IN THEIR OWN PACKAGING, together with the original documentation relating to the goods and the tax documents received with the goods, AT THE CUSTOMER'S COST. Shipping costs ARE NOT REFUNDABLE.
In order to exercise the return right, the customer must contact Ferramenta Russo by Russo Sabino by telephone or through the online form, indicating that he/she wishes to exercise the return right, indicating the number of the document received with the goods or the order number. Upon receipt of the communication, we will proceed to facilitate the collection, indicating the address to which the customer must return the product. Once the product has been received to Ferramenta Russo by Russo Sabino and its condition has been checked, we will proceed to refund the amount by bank transfer to the C.C. indicated by the customer.

2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The Customer, by confirming his order by e-mail, unconditionally accepts and undertakes to comply with the general terms and conditions of sale and payment set out below in all his dealings with Ferramenta Russo by Russo Sabino, declaring that he has read and accepts all the information provided to him in accordance with the above provisions, and also acknowledges that Ferramenta Russo by Russo Sabino does not consider itself bound by any other terms and conditions, unless previously agreed in writing.
3. CUSTOMER COMMITMENTS
The general terms and conditions of sale must be read IN LINE by customers visiting the ferramentarusso.com website before confirming their purchases. The sending of the order confirmation therefore implies full knowledge and acceptance of these general terms and conditions of sale.
The Customer undertakes to print out and keep these general terms and conditions of sale, which have been read and accepted during the purchase process, once the online purchase process has been completed.
It is strictly forbidden for the Customer to enter false and/or invented and/or fictitious data in the registration process required to activate the process for the execution of this contract and any other related communications; the personal data and the e-mail address must be exclusively the Customer's own real data and not those of third parties or fictitious data.
It is expressly forbidden to make double registrations corresponding to a single company/consumer or to insert data of third parties. Ferramenta Russo reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
4. REQUEST A QUOTE
Any request for a quotation sent by e-mail does not constitute a 'sales order'.
In response to such requests, Ferramenta Russo by Russo Sabino will act exclusively for the purpose of providing the information requested.
5. ORDERS AND TRANSPORT COSTS
The purchase is made by the Customer and concerns the products available, as illustrated and described ON LINE in the relevant descriptive and technical sheets (the images are to be understood as indicative, the product may present variations from an aesthetic point of view). All product prices are exclusive of VAT.
Shipping costs are charged to the customer based on the weight of the items purchased and are displayed at the time of purchase.
In both cases, the exact quote will be sent by email and will be listed in the 'Current Orders' section.
Before confirming the purchase, the Customer will be shown the unit cost of each product selected, the taxable amount, the VAT amount, the shipping costs and the total cost.
By confirming the purchase, the Customer will be able to print the details of his order and will automatically receive by e-mail a summary of the registered order.
The validation of the order is only understood when Ferramenta Russo di Russo Sabino confirms the shipment of the goods. The advance payment of a delivery does not constitute a confirmation of acceptance of the order, it can be refused by the house and refunded minus the costs of return bank transactions.
We point out that the goods ordered depend exclusively on the will of the customer. Under no circumstances can it be refused, otherwise the return costs will be charged. Ferramenta Russo by Russo Sabino will take legal action against the customer if the customer does not pay the shipping costs within 15 days (notified by e-mail). The order on the Internet is recognised as a normal commercial contract concluded by the buyer in his own hand.

6. PAYMENTS
Payment for the products purchased and the associated shipping costs must be made by the customer in the following ways CREDIT CARD, BANK TRANSFER or CASH ON DELIVERY (COD)(ONLY WHEN APPROVED).

Bank Transfer
Payment by bank transfer is subject to the following conditions: the bank transfer must be received within 5 working days of placing the order. After this date, the order will be considered null and void. The reason for payment on the bank transfer must indicate: the number and date of the order, the name of the company or the name of the purchaser; the bank details are:

It is understood that if you choose to pay by bank transfer, the goods will not be dispatched until the amount has been credited to our bank account. In the current state of the banking system, the transferred amount is credited to the beneficiary's bank account no earlier than 1/3 working days from the date of the transfer.

Cash On Delivery (COD)
Payment by cash on delivery (which involves an additional fixed charge) is to be made to the courier on delivery of the product in cash, bank draft or cheque made payable to the courier (if accepted by the courier).
7. PRODUCT AVAILABILITY AND DELIVERY
The products purchased on the ferramentarusso.com site are delivered throughout Italy. The products purchased are delivered by Ferramenta Russo by Russo Sabino by standard or express courier to the address indicated by the customer.
The goods travel on behalf of and at the risk of the purchaser. Any claims for damage or tampering during transport must be made directly and in writing to the carrier. On delivery, the customer must check that the packages are intact and that the quantity and quality correspond to what is stated in the accompanying document. Any discrepancies (missing parcels compared to those indicated on the transport document, open parcels, damaged parcels, etc.) must be reported on the accompanying document and within 48 hours by fax to Ferramenta Russo di Russo Sabino.
The products are delivered every working day. The delivery of products by Ferramenta Russo can be fractioned, without any responsibility for Ferramenta Russo di Russo Sabino In the event that the product(s) ordered are not in stock (even if available on the site ferramentarusso.com), the customer will be contacted by e-mail or telephone to inform him/her of the time required for the new delivery. In case the order is shipped in several stages, Ferramenta Russo will be responsible for the additional shipping costs.
Indicatively, without implying any obligation for Ferramenta Russo di Russo Sabino, and subject to the availability of products on the market, as well as any force majeure events, the goods will be delivered according to the following schedule:
In the case of bank transfer, the shipment will be entrusted to the courier within 24/48 hours of receipt of the funds;
in the case of payment by cash on delivery, provided that all the obligatory conditions are met, Ferramenta Russo di Russo Sabino will deliver within 24/48 hours from the time the order is placed;
Except for the islands, for which 72 hours are expected.
Delivery times are indicative and will be considered valid in any case if there are no physical or structural obstacles (e.g. incorrect addresses or force majeure events). The transport cost, which will be added to the price of the products purchased, will be calculated automatically by the system.
8. DELIVERY DELAY
It is possible that the package does not arrive within the timeframe established or proposed on the ferramentarusso.com website. In this case, the customer can contact the Customer Service of Ferramenta Russo di Russo Sabino and open a file to locate the package. Ferramenta Russo is not responsible for any damage or loss, direct or indirect, resulting from the delay or non-delivery of the product.
9. PRODUCT WARRANTY
All products are covered by the manufacturer's warranty in accordance with the terms and conditions established by the manufacturer. This guarantee is limited to the item sold and excludes any other service, indemnity or compensation.
This guarantee applies to products that have conformity defects and/or malfunctions that could not be detected at the time of purchase, provided that the product itself is used correctly and with due care, i.e. in accordance with its intended use and with what is stated in any technical documentation and in compliance with the various operating standards indicated therein.
In any case, the applicable guarantee conditions are those indicated and highlighted by the manufacturer. Anyone who buys material from Ferramenta Russo by Russo Sabino accepts with the purchase the manufacturer's warranty conditions in their entirety, which may be independent of the will of Ferramenta Russo by Russo Sabino.
On the other hand, the aforementioned guarantee is not applicable in the event of negligence, carelessness in the use and maintenance of the product, connection of the purchased goods to electrical installations or any other type of connection that does not comply with the standards.
10. RETURN
The following returns policy applies in two different circumstances:
- In the event of error by Ferramenta Russo by Russo Sabino in accepting, sending or delivering the order;
- In the event that Ferramenta Russo by Russo Sabino decides, at its own discretion or by agreement with the customer, to apply more favourable provisions for the customer.
The goods are delivered from our warehouse in Ferramenta Russo. Unless otherwise specified by the purchaser, delivery is free of charge. The material travels at the risk and peril of the purchaser, even if it is sent carriage paid. Complaints can only be accepted if notified by letter, fax or e-mail within eight days from the date of receipt of the material; after this period any right to complain will be lost.
11. CUSTOMER RETURNS
Goods must be sent carriage paid to our central warehouse.

Your return note or document with Ferramenta Russo by Russo Sabino reference number, customer number and clear reason for return.
Undamaged products
Packaging and labels intact or in the condition in which they were delivered
Products not purchased as part of a promotion, even if returned in full
Products returned within one month of receipt of goods.
For chemistry products
Products with an expiry date will not be accepted as returns if they meet the order specifications.
For special products
Products not included in the catalogue or, in any case, delivered according to special customer requirements, will only be accepted if the goods delivered do not comply with the conditions and specifications indicated in the order.
Ferramenta Russo by Russo Sabino will therefore refuse any product returned unpacked, as well as any product for which the customer has not already paid the return costs in full.
Ferramenta Russo by Russo Sabino will refuse any product that has not been fully paid for by the customer, or that has not been packed in its original packaging, or that is not complete with all accessories, manuals and everything that was originally included.
12. REFUND
Ferramenta Russo by Russo Sabino will proceed to the transmission of the order for the refund of the cost of the goods dispatched within 30 working days from the dispatch of the goods by the customer and in any case not before the receipt of the goods. The refund will be paid by bank transfer. The cost of returning the goods to the sender shall be borne by the customer.
PLEASE NOTE: From the moment the package is opened by the customer, Ferramenta Russo by Russo Sabino declines all responsibility. All products (original packaging, accessories, manuals and original contents) returned by the customer will be examined by the "RETURNS SERVICE", which takes an average of 15 days to carry out a complete examination.
13. PRIVACY
Pursuant to L. 675/96 the Customer also declares to be aware that the data provided will be entered into the "Customer Data Bank of Ferramenta Russo" and may be used for promotional, commercial and sales purposes as well as for statistics by means of consultation, processing or comparison or for sending editorial and/or promotional material.

The interested party enjoys expressly and free of charge the rights under Art. 13 L.675 /1996, namely to request confirmation of the existence at Ferramenta Russo's premises of his personal data; to know their origin, logic and purpose of their processing; to obtain their updating, rectification and integration; to request their deletion, transformation into anonymous form or blocking in the event of unlawful processing to oppose their processing for legitimate reasons or in case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication, it being understood that obtaining the cancellation of one's own personal data is subject to a written communication sent to the headquarters of Ferramenta Russo.

This contract is governed by Italian law and for any dispute relating to the validity, interpretation or execution of this contract, the Customer accepts the jurisdiction of the Italian State and, in any case, the application of Italian law in force at the time of the dispute, regardless of the Customer's domicile or seat, to the Court of MILAN.
